Certain debt collectors intentionally delay notifying consumers of default judgments on debt in order to more easily go after the consumer’s wages. SB641 gives consumers, in limited circumstances, the ability to fight back against abusive debt collection tactics by asking courts to set aside default judgments and hear cases on the merits within 180 days after the first actual notice of a lawsuit. It ensures that consumers can defend themselves in situations where, through no fault of their own, they received no initial notice they were being sued.
